Terms of Service & Privacy Policy

These Terms of Service ("Terms") govern your access to and use of Flare Heartz's website located at flareheartz.com and all services offered by Flare Heartz (the "Service Provider"), including but not limited to Shopify store setup, custom website design, domain configuration, branding, and monthly store management.

By accessing our website, submitting a contact form, making a payment, or engaging our services in any capacity, you ("Client" or "you") agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not use our website or services.

Flare Heartz reserves the right to update these Terms at any time. Continued use of the website or services after changes are posted constitutes acceptance of the revised Terms.

Flare Heartz offers the following services to clients:

• Shopify Store Setup — Full store configuration including theme installation, product listing, payment and shipping setup, and basic branding
• Custom Website Design — Multi-page website design and development tailored to the client's brand
• Domain Setup — Configuration and connection of a client-owned domain to their store or website
• Brand Starter Kit — Logo treatment, color palette, and typography selection
• Monthly Store Management — Ongoing store updates, monitoring, and support on a contract or flexible basis
• SEO Foundation — Basic on-page search engine optimization including meta tags, page titles, and image alt text

Deposits: All one-time setup projects (Starter and Pro packages) require a 50% non-refundable deposit before work begins. The remaining 50% is due upon project completion and delivery, before the store or website is handed over to the client.

Monthly Management: Monthly management fees are due at the start of each billing cycle. The 6-month contract plan is billed at $50.00 per month for six consecutive months. The flexible plan is billed at $75.00 per month with no contract commitment.

Payment Processing: All payments are processed securely through Stripe. Flare Heartz does not store any credit card or banking information. By submitting payment you agree to Stripe's terms of service.

Late Payments: If a payment is not received within 5 business days of its due date, Flare Heartz reserves the right to pause services until the outstanding balance is resolved.

By engaging Flare Heartz's services, the Client agrees to:

• Provide accurate, complete, and truthful information during onboarding and throughout the project
• Supply necessary assets (logos, photos, product descriptions) in a timely manner to avoid project delays
• Communicate respectfully with all Flare Heartz team members at all times
• Not request the creation of content that is illegal, fraudulent, defamatory, or in violation of any third-party platform's terms of service (including Shopify)
• Maintain their own active Shopify subscription and any required third-party app subscriptions
• Not resell, sublicense, or represent Flare Heartz's work as their own agency's services without prior written consent

Flare Heartz reserves the right to terminate any project or service immediately and without refund if a client engages in abusive, threatening, or harassing behavior toward any Flare Heartz team member.

Flare Heartz provides all services on an "as is" basis and makes no guarantees regarding specific business outcomes, sales figures, search engine rankings, or revenue generated as a result of our work.

To the maximum extent permitted by applicable law, Flare Heartz shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• The use or inability to use our services
• Third-party platform outages (including Shopify, Stripe, or domain registrars)
• Changes made to the client's store by unauthorized third parties
• Loss of data, revenue, or business opportunities
• Any errors or inaccuracies in content provided by the client

In no event shall Flare Heartz's total liability to any client exceed the total amount paid by that client for the specific service giving rise to the claim.

These Terms are governed by and construed in accordance with the laws of the State of Florida, United States. Any disputes arising from these Terms or Flare Heartz's services shall be resolved in the appropriate courts of Florida.

Flare Heartz reserves the right to modify these Terms at any time without prior notice. The most current version will always be available at flareheartz.com/legal. Your continued use of our services after changes are posted constitutes acceptance of the updated Terms.

• Maintain records of signed contracts and payment agreements
• Improve our website and services based on general usage patterns
